Terms of Service

1. Acceptance of Terms
By accessing or using the Workflare platform ("Platform"), including the marketplace, documentation, APIs, and any associated services operated by Workflare ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.
2. Platform Description
Workflare is a modular business application platform. It provides a shell application, a marketplace for discovering and installing apps, and developer tools for building and publishing apps. Each customer deploys Workflare to their own cloud infrastructure — we do not host your data or run your workloads.
The Platform connects three parties: customers who deploy and use apps, publishers who build and distribute apps through the marketplace, and Workflare which operates the platform, marketplace, and review process.
3. Accounts
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms, contain misleading information, or are used for unlawful purposes.
4. Marketplace and Publisher Responsibility
The Workflare marketplace allows third-party publishers to distribute apps to customers. We review apps during the approval process and make reasonable efforts to ensure that published apps meet our quality and security guidelines. However:
- Each publisher is solely responsible for their published apps, including their functionality, accuracy, security, compliance with applicable laws, and any data they process.
- Our review process is a best-effort measure to uphold high standards, but it does not constitute a warranty, guarantee, or endorsement of any third-party app.
- We do not assume liability for damages, data loss, security vulnerabilities, or any other issues arising from the use of third-party marketplace apps.
- Publishers must comply with our Publisher Guidelines and are responsible for providing support for their apps.
Customers are encouraged to review app descriptions, publisher information, and community feedback before installing third-party apps.
5. Customer Responsibilities
As a customer, you deploy Workflare and marketplace apps to your own cloud infrastructure. You are responsible for:
- The security and configuration of your cloud environment, including access controls, network policies, and encryption settings.
- Ensuring that your use of the Platform and installed apps complies with all applicable laws and regulations, including data protection laws.
- Backing up your data. Since data resides in your infrastructure, you are solely responsible for data backups and disaster recovery.
- Evaluating the suitability of third-party apps for your use case before installing them.
6. Intellectual Property
The Workflare platform, including its source code, documentation, branding, and first-party apps, is open source software licensed under the MIT License. This license grants you the right to use, modify, and distribute the software, subject to the terms of the MIT License.
Third-party marketplace apps are owned by their respective publishers and may be subject to their own license terms. The publisher's license terms govern your use of their apps.
7. Payment and Billing
Workflare's platform pricing is described on our Pricing page. The Starter plan is free for teams of up to 5 users. Paid plans are billed monthly and are non-refundable except where required by applicable law.
Third-party marketplace apps may have their own pricing set by the publisher. Payments for third-party apps are processed through the platform. Publishers receive payouts according to our publisher revenue-sharing terms.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Workflare and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Platform.
In particular, we shall not be liable for any damages caused by third-party marketplace apps, including but not limited to data loss, security breaches, service interruptions, or incompatibility issues. The responsibility for third-party apps rests entirely with their publishers.
9. Disclaimers
The Platform is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Platform will be uninterrupted, error-free, or secure, or that any defects will be corrected. Our marketplace review process does not guarantee the safety, quality, or legality of third-party apps.
10. Termination
You may stop using the Platform at any time. Since Workflare deploys to your own infrastructure, your data remains yours — there is no lock-in.
We may suspend or terminate your access to the Platform or marketplace if you violate these Terms. Publishers who violate our guidelines may have their apps removed from the marketplace and their publisher accounts suspended.
11. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by updating the effective date at the top of this page and, where appropriate, through the Platform. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the European Union and the applicable national laws of the jurisdiction in which Workflare operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the competent courts of that jurisdiction.
